摘要  學校教育中之個人成績紀錄,乃是相當重要的學生隱私資料,本應僅對學校及學生當事人雙方進行揭示。惟基於評量結果之慣有運用模式,學校亦有公告學生成績或對第三人(學生家長或其他第三人)逕行揭示學生成績等行為。本文以尊重學生資訊自決權為出發點,參酌國內外保護個人資料相關措施及規範,除嘗試藉此歸結出學校揭示學生成績之一般性原則,亦將分就學生成績之權利主體與管理責任兩大面向,提出實務操作層面所應具備的基本認知及原則,並期藉此深化校園民主及法治教育。最後,本文依據相關探討結果,進一步提出公私一體之法規適用、法規漏洞之有待填補、超越免責之行政善意等三項實務建議。
摘要(外文)  Student records are important private information in schooling. While they should only be disclosed to students themselves, in actuality student records are often disclosed publicly either to student parents or to a third party as part of the evaluation routine. Based upon the notion of respecting students' right to informational self-determination, this study aims at examining general principles regarding disclosing student records in school. It also scrutinizes the current measures and norms related to personal data protection in Taiwan. The exploration in this study attempts to promote democracy and law-related education on campus.
